The Conatix Cysana (CyberSecurity Analytics) real-time data protector and insider fraud detection system tracks employees of a bank or company insider online behavior to monitor unusual or suspicious activity that may indicate misuse or misappropriation of confidential bank customer data or other company data.

CONATIX PRACTICES REGARDING YOUR PRIVACY

We at Conatix are committed to respecting your privacy and recognize your need for appropriate protection and management of any information you share with us. This policy describes how Conatix Corp., a Virginia USA corporation which provides you with the software and support services, collects, shares and uses personal information about you, and how you can exercise your privacy rights. This policy applies to the information we collect from you, including through your use of our Software products on behalf of and as authorized by our customers, who are private corporate or public entities, the performance of our services, the https://conatixcyber.com/ & https://www.cysana.co/ website and any other websites that display or link to this Privacy Policy, and other advertising mediums, including but not limited to email, newsletters, conference sign-ups and leave-behinds. This policy does not apply to the practices of companies that Conatix does not own or control, or to people that Conatix does not employ.

The aim of this Policy is to provide a clear and transparent explanation of what information we collect about End Users, how we use it, and how we share it. One important thing we want you to keep in mind is that this Policy covers only the information that Conatix handles, thus it does not explain what Our Clients do with your information. We do encourage you to review their privacy policies to know about their practices.

    • When you interact with us by e-mails or other communication tools;

    • When you use our software products and the related documentations and our support services but excluding Third Party Software.

  • We use information differently depending on what type of End User you are. We divide End Users in two categories:

    • Persons who use a device to connect to our Website (“Website Users”); and

    • Consumers who use our Software (“Software Users”).

This Policy explains how we collect, use, and share information from both types of End Users.

We encourage you to read it thoroughly and are confident that you will easily understand how we gather, store and process your data plus the choices available to you.

If you use the Website or/and the Software, you consent to this policy and the use/sharing of your personal data as described herein. You have the choice to opt-out of sharing your data at any time, as described below, and control how we use and share your data.

 

In matters pertaining to International laws for the protection of privacy, Conatix is designated as the data controller of Conatix Website and Software. In other words, Conatix is the organization that, alone or jointly, determines for what purposes and how your personal information will be treated or is likely to be processed.

 

This Privacy Policy is part of our Terms of Usead regarding your access and use of the Website and License Agreement regarding the access, download, install, use or copy of the licensed software.

This Policy does not apply to the Personal Information of Conatix employees, consultants or other individuals or to any information that does not constitute Personal Information.

1. What personal information do you collect about me, and for what purposes?

Personal information is collected only when voluntarily offered and solely for purposes that are clearly identified in this privacy policy. Personal information means any information that is unique to you.


We collect personal information to provide you with our Services. We collect personal information for the purpose of providing the Services and to obtain analytics.

Note: Our Website and Software does not require you to include sensitive information (e.g. racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union memberships, genetic data, biometric data or data concerning sexual orientation). In the event that you provide such sensitive information as listed above you acknowledge that you have provided us with explicit consent to collect such information.

Your consent to use deidentified information. By using our Website or Software, all users accept and agree that we will be allowed to use any information that they have included in this Website or Software, so long as we will first de-identify this information, meaning that we will make the information anonymous by removing the user’s name and other personally identifying pieces of information. We may use this information towards research and development and quality improvement for this Website and Software.

2. What types of cookies and other tracking technologies do you collect, and for what purposes?

Cookies are small text files that are stored in a computer’s web browser memory. When we use the term cookies in this policy, we also imply similar tracking technologies such as pixel tags (also known as web beacons and clear GIFs). We also collect mobile advertising identifiers which are then used to serve our ads.

We use both first party cookies (installed by Conatix) and third party cookies (installed by our partners and service providers). We use four (4) types of cookies: essential, analytical, functionality and marketing.

3. Where do you store personal information?

3.1 Website Users
We store personal information on Azure server located in USA and Canada. However,
our suppliers may collect, use and disclose personal information outside of these
territories.


3.2. Software Users
Personal information collected via the use of the Software stay on-premises meaning you data remains in house, so no internet connection is needed, and the data is always available in your Server(s) in your Data center(s).

4. How do you protect personal information?

We are committed to protecting the confidentiality, integrity and availability of your personal information when you use our Website where your information are transmitted via Internet or when you use our Software where the information servers stay onpremises in your data centers.

4.1. Transmission of information via Internet
When you use our Website and we collect your personal information for the purposes described in sections 1 and 2, Conatix employs the security safeguards it believes to be appropriate to the sensitivity of the information, including physical, administrative, and technological measures. Examples of such measures include training of personnel, limiting access to information on a “need-to-know” basis, using passwords and relevant internal policies and practices. Unfortunately, the transmission of information via the internet is not completely secure. Although Conatix does its best to protect a User’s personal information, it cannot guarantee the security of data transmitted to us. Any transmission a user provides is at their own risk. Once we have received a user’s information, we will apply our security practices to try  to prevent unauthorized access, use and/or disclosure. As a result, we do not assume any responsibility for the data you submit to or receive from us through the Internet or for any unauthorized access or use of that information and we cannot and do not guarantee that information communicated by you to us or sent to you by us will be received or that it will not be altered before or after its transmission to us. You agree to not hold us and our respective past, present and future employees, officers, directors, contractors, consultants, equity holders, suppliers, vendors, service providers, parent companies, subsidiaries, affiliates, agents, representatives, predecessors, successors and assigns (collectively, the “Parties”) liable for any loss or damage of any sort incurred as a result of any misappropriation, interception, modification, deletion, destruction or use of information provided through our Website and Software.


4.2. On-premises data
Software Users are running their own on-premises servers to retain more complete control over security. In consequence, Software Users are responsible for setting appropriate user access policies, installing firewalls and antivirus software, ensuring security patches are installed promptly, and guarding against cyberattacks. As a result, Software Users retain full and sole responsibility for all data and digital content on their servers. Conatix has no degree of control on these servers and their content. So Conatix is in no way responsible for any use made of the content of the servers nor for the use of the servers themself.

In all cases, Conatix uses contractual and other means to provide a comparable level of protection while information is being stored, handled and processed using any thirdparty service providers.

5. How long do you retain personal information?

We retain personal information as long as required to comply with legislations, or as required for our business purposes. Financial regulatory requirements may require that we keep transaction-related data for an extended period of time for anti-money laundering and fraud monitoring purposes. We use both session cookies and semi-permanent cookies, but none of our cookies remain installed more than 2 years.

6. Who do you disclose my personal information to?

We do not allow the disclosure of personal information to third parties, except as strictly required to perform the Services. We do not sell your personal information to data brokers. We conduct digital marketing using marketing partners. We perform analytics and we use other IT service providers. We may transfer ownership of your data in the case of a merger and acquisition, or other corporate transactions.


Conatix may process a user's personal information based on legal grounds provided by applicable law including, but not limited to: where it is necessary to enter into a contract with you in order to provide our Services; to comply with legal obligations as set by applicable law (such as for tax purposes); for our legitimate interests (such as for to prevent fraud, or in the event of legal disputes resulting from your subscription).


Conatix, its third-party service providers and other third parties to whom Conatix discloses information may perform processing activities outside of Canada. Any user’s personal information that is accessed, stored or used in any other way in these countries may be subject to the laws of those countries. As a result, personal information may be disclosed in response to valid demands or requests from government authorities, courts, or law enforcement officials in countries outside of Canada. However, our practices regarding your personal information remain at all times governed by this Privacy Policy and, if applicable, we will comply with the requirements of the GDPR by providing adequate protection regarding the transfer of personal information between the EU or the EEA and the third country. Conatix will hold companies outside Canada responsible under Canadian law for any personal information that may be transferred to them.

From time to time, Conatix may also share general information about the Software users, such as the number of users and aggregate and/or non-personally identifiable demographic with third-parties.

The Services may provide the ability to connect to other websites. If you click on links towards third parties or on advertising, these third parties are not our suppliers, and they process your personal information based on their own privacy policies, which you should review. We are not responsible for the content and privacy practices of these third parties.
 

We may also share your personal information with our auditors and consultants if they are under a confidentiality obligation, and if they reasonably need to access such information as part of their engagement with us.

7. What are my rights regarding my personal information?

By providing us with your personal information, you expressly consent for us to collect, hold, use and disclose your personal information in accordance with this Privacy Policy. In addition to providing the foregoing information, if you choose to correspond further with us through e-mail or through the “contact” section of our Website, you expressly consent that we retain, use and disclose the content of your messages together with your e-mail address and our responses.

You may withdraw your consent at any time however such withdraw does not affect the legality of the treatment of your Information before such withdraw.
 

The extent of your rights depends on the laws that apply to the processing of your personal information so your rights may vary. Most legislations minimally provide you
with these rights:

  • The right to be informed about the personal information we process about you;​

  • The right to access the personal information we process about you;

  • The right to modify the personal information we process about you, such as when 
    it is inaccurate.

  • The right to request that some of your personal information be provided to you, or
    to another data controller, in a commonly used, machine-readable format.

  • The right to delete your personal information when the personal information is no
    longer necessary for the purposes for which it was collected, or when, among other
    things, your personal information has been unlawfully processed. The foregoing
    does not apply if further processing is necessary to:

    • To ensure the exercising of the right to freedom of expression and
      information;

    • to fulfil a legal obligation;

    • to assert, exercise or defend legal claims.

  • The right to demand the restriction of the processing of your personal information, provided that

    • the correctness of the data is disputed by you;

    • the processing is unlawful, but you refuse to delete it;

    •  we no longer need the personal information, but you need it to assert,
      exercise or defend legal claims

  • The right to object to processing of your personal information in certain circumstances and to ask us to block, erase and restrict your personal information. If you would like us to stop using your personal information, please
    contact us on our contact form.

We are currently not in-scope of the California Consumer Privacy Act, and we do not respond to “Do Not Track Signal”. However, if you have a legitimate request about your personal information, we will try our best to assist you.

Prior to respond to your request, we will need to confirm your identity. We may also refuse to respond to your request if the applicable laws do not allow for the exercise of certain rights or for other valuable and legal reasons. If we cannot respond, we will inform you of the reasons. We will respond to your request within 30 days, or within the legal delay prescribed by the law.


If you are not satisfied with our we handled your request, you can lodge complaints to your local authorities. For instance, in Canada, you can lodge your complaint at the Office of the Privacy Commissioner by consulting the information available here.

8. Can I manage my preferences regarding cookies?
Yes! However, some functionalities may require cookies in order to perform as expected, or for security purposes, such as for payment processing. 10. Can I delete my account with you?
Yes, you can delete your account entirely by reaching out to us at conatixadmin@conatix.com.


11. Can you change this privacy policy?
Yes. We plan on adding many functionalities and on continuing to develop our Services. As a result, we may need to change this privacy policy to reflect how we process personal information over time. We may also change this privacy policy to reflect new legislations, new technologies or as reasonable required. If we change this privacy policy, we will advise our users by e-mail. If you continue to use our Services, you will be deemed to accept these changes. You can refer to the latest update date above to know when we last updated our privacy policy.
